The State Farm® MORE MUSIC IN MORE NEIGHBORHOODS PROMOTION
NO PURCHASE NECESSARY TO PARTICIPATE. VOID OUTSIDE OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA AND WHERE PROHIBITED OR RESTRICTED BY LAW.
1.Eligibility: The State Farm More Music in More Neighborhoods Promotion the (“Promotion”) is open to legal residents of the fifty (50) U.S. and the District of Columbia who are at least 13 years of age. Participants who have not yet reached the age of majority in the jurisdiction in which they reside must obtain parental or legal guardian consent to be eligible to participate in Promotion. Employees, officers and directors of State Farm Mutual Automobile Insurance Company (“Sponsor”) and The Marketing Arm Inc. (“Administrator”) will hereinafter collectively be referred to as (“Promotion Entities”). State Farm independent contractor insurance and financial services agents and their staff and each of their respective parents, subsidiaries and affiliated companies, representatives, directors, officers, agents, divisions, dealers, affiliates, distributors, advertising and promotional agencies, employees and assigns, and any entity which is involved in any aspect of the creation, production, operation or execution of the Promotion will hereinafter collectively be referred to as (“Released Parties”). This Promotion is subject to all applicable federal, state, local laws, rules and regulations. Void where prohibited or restricted by law, rule or regulation. All interpretations of these Terms and Conditions and decisions made by Sponsor relating to this Promotion are final.
By participating in this Promotion, participants: (a) agree to be bound by these Terms and Conditions and by the interpretations of these Terms and Conditions by Sponsor and by the decisions of Sponsor; (b) acknowledge compliance with these Terms and Conditions; (c) represent and warrant that he or she meets all the eligibility criteria set forth in these Terms and Conditions; (d) agree to comply with any and all applicable federal, state and local laws, rules and regulations; and (e) agree to indemnify and hold harmless Promotion Entities and Released Parties from and against any and all liability arising out of or relating in any way to participant’s participation in Promotion and to release all rights to bring any claim, action or proceeding against Promotion Entities and Released Parties. This includes, but is not limited to, any and all claims, demands, damages and causes of action for personal injuries or death and/or damage to personal or real property, theft, loss or any other harm, suffered directly or indirectly from participant’s participation in Promotion and for any claim including claims based on defamation, publicity rights, invasion of privacy, copyright infringement, trademark infringement, or any other intellectual property related or other cause of action.
2. Participation Period: The Promotion takes place during the following festivals:
Bonnaroo Music and Arts Festival taking place in Manchester, Tennessee on June 13 – June 16, 2019, the (“Promotion Period”).
Country Lake Shake taking place at Huntington Bank Pavilion at Northerly Island, Chicago, Illinois on June 21 – June 23, 2019
Lollapalooza taking place at Grant Park in Chicago, Illinois – 11:00 AM – 8:00 PM August 1 – August 4, 2019
2019 Music MidTown taking place at Piedmont Park in Atlanta, Georgia – 12:00 PM – 8:00 PM September 14 – September 15, 2019
ACL Music Festival taking place at Zilker Park in Austin, Texas – 11:00 AM – 8:00 PM October 4-6, 2019 and October 11-13, 2019
Voodoo Music + Arts Fest taking place at New Orleans City Park, New Orleans, Louisiana- 12:00 PM – 8:00 PM October 25-27, 2019
All times above are in local time. The festival dates above will collectively be referred to herein as the (“Promotion Period”).
3.Promotion Overview: This Promotion is one (1) of eight (8) State Farm More Music in More Neighborhoods Promotions wherein State Farm is teaming with Notes for Notes™ to provide an opportunity for music fans to join them in supporting access to music education for youths. Fans participate by dancing, performing and listening to music at the State Farm: Neighborhood of Good interactive Promotions at specified 2019 music and arts festivals throughout the United Sates. Each time a participant enters one of the four interactive stations specified below and scans the RFID wristband (provided at the entrance to the event) at the entrance to that station, State Farm will give $10 to Notes for Notes™ to help Notes for Notes™ fulfill their mission of providing positive music experiences in the lives of youths.
Notes for Notes™ is a non-profit organization dedicated to providing youth with free access to music instruments, education, instruction and recording studio environments. Notes for Notes™ is located at 1718 Church Street, #331916, Nashville, TN 37203.
State Farm will be participating at up to eight (8) music and arts festivals in the United States throughout 2019. State Farm will give Notes for Notes™ up to a total maximum of $500,000 from the qualified participation of fans from all of these eight (8) music and arts festivals.
4.To Participate: To participate in each or any of the four (4) interactive stations listed below, scan your RFID wristband at the entrance to each station and follow the participation directions provided by the State Farm brand ambassador located at each station. Videos will be taken of each participant’s participation at the Dance Hall, Music Venue and Recording Studio stations. These videos will be posted on a Promotion content hub personal to each participant. Shortly after participant’s completion of activity at the first station, Sponsor will send one (1) email to participant to the email address provided by participant at time of registration. This email will contain a link to participants personal content hub where participant can view any videos taken of participant at these stations and will also post a tally of dollar amount participant generated via their participation that will be sent by Sponsor to Notes for Notes™. In addition, Sponsor may send up to one (1) more email to participant relating to their involvement in Promotion. By participating in Promotion, participant hereby grants permission to Sponsor and or Administrator to be contacted via email.
Record Store: Listen to It to help a youth share their voice. Step in and support musical inclusion by listening to songs from Notes for Notes™ youth artists. Once the door closes the musical and visual experience begins.
Dance Hall: Dance Along to join a movement for musical inclusion for youths. Step on the dance floor and support music inclusion by dancing on a reactive LED dance floor.
Music Venue: Perform It to a drum solo to help youths play music together. Support musical inclusion by playing along on a custom drum set that tests your speed and agility.
Recording Studio: Sing Along to help give youths access to recording sessions. Step into a multi-sensory recording booth and support music inclusion by singing along to a Notes for Notes™ track. The recording studio provides an immersive visual infinity room experience.
Each participant understands and agrees that Sponsor and/or Administrator have the right, at their sole discretion, to disqualify and remove the participant from any activity at any time without compensation if such person’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Sponsor or Administrator or otherwise violates the policies of the Sponsor or Administrator.
Each participant can participate at each interactive station as many times as they want during each day of the Promotion Period, but only the first RFID wristband scan at each interactive station will trigger State Farm to give $10 to Notes for Notes™ up to a maximum of $40 ($10 for each of the four (4) separate interactive stations participant may participate in subject to the $500,000 maximum specified in this Section 4 above).
5.Publicity Release: By participating in Promotion, each participant grants to Sponsor, and its representatives, affiliates, licensees and assigns, the right and permission to record, film, videotape and photograph the participant (“Images”) and to use, re-use, reproduce, publish, display, exhibit, distribute, edit, adapt, post, stream, and copy the participant’s name, voice, city/state of residence, photograph, biographical information, and/or likeness, Image and any other attributes of participant, individually or with others, in whole or in part, in conjunction with other material, for advertising, trade, publicity, promotion and/or for any other purpose in any and all media or format now known or hereafter devised, worldwide in perpetuity, without further compensation, consideration, permission or notification, except where prohibited by law.
6.General Terms: Promotion Entities are not responsible for any human, mechanical, equipment, programming or electronic error that may occur in the processing of the RFID scans during the Promotion or other errors appearing within the Terms and Conditions or in any Promotion related advertisements. Promotion Entities assume no responsibility for any typographical or other error in the printing of the offer, administration of Promotion, failures or malfunctions of telephones, telephone lines or telephone systems, computer systems, online systems, servers or providers or other communications malfunctions; interrupted or unavailable network, server or other connections, miscommunications, failed computer hardware or software or other technical failures, garbled, lost, misrouted or scrambled transmissions, any error, omission, interruption, defect or delay in any transmission or communication, traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to participant’s or any other person’s computer, computer system/software or mobile phone or other portable electronic device related to or resulting from participation in this Promotion. Use of any device to automate or subvert participation is prohibited and any RFID scans received by such means will be void. No software-generated, robotic, programmed, script, macro or other automated RFID scans are permitted and any RFID scans received by such means will be void. Sponsor reserves the right in its sole discretion to disqualify any person they suspect or find: (i) to have used a software generated, robotic, programmed, script, macro or other automated scanning method; (ii) to have tampered with the operation of Promotion; (iii) to be acting in a disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (iv) to display behavior that will bring such participant or Promotion Entities into disgrace; (v) to have provided inaccurate information on any legal documents submitted in connection with Promotion; or (vi) to be acting in violation of these Terms and Conditions.
7.Miscellaneous: Promotion Entities and Released Parties are not responsible if Promotion cannot take place due to delays, interruptions or failures due to acts of God, war, natural disasters, weather, acts or threats of terrorism, strikes, lockouts, labor disputes, work stoppages, fire, acts of government, or other events outside of the reasonable control of Promotion Entities. If, for any reason Promotion is not capable of running as planned, including, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of Promotion Entities, which, in Sponsor’s sole determination, corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend Promotion or any part of the Promotion. If Promotion or any part of the Promotion is terminated or modified prior to the closing date of the Promotion, notice will be posted on https://music.neighborhoodofgood.com/rules if time permits. Failure by Sponsor to enforce any term of these Terms and Conditions shall not constitute a waiver of that provision.
ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH PARTICIPANT, AND SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES (INCLUDING ATTORNEYS’ FEES) AND DAMAGES FROM ANY PERSON RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
8.Disputes/Choice of Law: Except where prohibited, each participant agrees that: (i) all issues and questions concerning these Terms and Conditions shall be governed by Illinois law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this Promotion shall be (a) resolved individually, without resort to any form of class action; and (b) filed only in the state or federal courts situated in McLean County, Illinois State and participant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys’ fees; and (iv) under no circumstances will any participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
